JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 24-08-2021 Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offence punishable under Section 302, 201/34 of the Indian Penal Code.

As per the prosecution case, on 25.05.2018 at 2.30 PM on the order of co-accused, Deepak Singh, this petitioner is alleged to have caused injury at the neck of husband of informant by means of Tangi and co-accused Devendra Singh inflicted Dab blow on the leg of her husband. It is further alleged that after keeping the dead body of the husband of informant near the husk and woods, co-accused poured kerosene oil and set the dead body ablaze.

Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the

Patna High Court CR. MISC. No.30131 of 2021(3) dt.24-08-2021 2/2 case along with his entire family members due to family dispute at the instance of female members of the informant's family. There is general and omnibus allegation against this petitioner and no specific overt act has been alleged against this petitioner. Similarly situated, co-accused, Sidhi Devi, has already been granted bail by a co-ordinate Bench of this court vide order dated 06.10.2018 passed in Cr. Misc. No. 62345/2018. Petitioner is in custody since 01.07.2018 and investigation in this case is complete.

Learned counsel appearing for the State opposes the prayer for bail and submits that there is specific allegation against this petitioner that he caused injury at the neck of informant's husband by means of Tangi.

Considering the nature of allegation against this petitioner and gravity of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, the same is rejected. (Prabhat Kumar Singh, J) BKS/- U T
