JUSTICE ARUN KUMAR ORAL ORDER 09-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Sections 272, 273 of the Indian Penal Code and 30 of Bihar Prohibition Excise Act.

Allegation in brief is that the petitioner was selling country made liquor and when police officials raided, accused persons escaped away but 40 litres of country made liquor was recovered behind the bush but there is no any recovery from the possession of the petitioner.

It is submitted that mere on suspicion his name was disclosed by the informant, police officer without any basis even any local person has not raised any suspicion against the petitioner.

No.5568 of 2017 (4) dt.09-02-2017 2/2 Considering the aforesaid facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner, namely, Jai Prakash Singh be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M.4, Saran at Chapra in connection with Kopa P.S. Case No.152 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. and further condition that in future, his bail bond shall be cancelled, if he is found in similar nature of offence.
