The petitioner seeks bail in Khagaria (Muffasil) P.S. Case No.325 of 2018 registered under Sections 341, 379, 504, 506, 323 of the Indian Penal Code and Section 27 of the Arms Act.

The informant alleged that the petitioner came to his shop and demanded mustard oil on credit when the informant refused to give article on credit without payment of arrears of dues, the petitioner is alleged to have fired but the same did not hit anybody. It is alleged that the petitioner took out money from the shop and fled away.

The learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case on the ground of

Nothing has been recovered from the possession of the petitioner and the petitioner is in jail since 11.08.2018 without having any criminal antecedent. Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that the petitioner is in jail since 11.08.2018, the petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria (Muffasil) P.S. Case No.325 of 2018, G.R. No.1345 of 2018.
