Petitioner seeks bail in a case registered for the offences punishable under Sections 8C/21(b)/27 of N.D.P.S. Act.
Petitioner is named in the first information report but it is evident from perusal of first information report that on the day of institution of the present case, petitioner was in jail custody in connection with another case and furthermore, it would appear from perusal of the FIR that name of petitioner was disclosed by co-accused Guddu Kumar.
Admittedly, nothing was recovered from conscious
Patna High Court CR. MISC. No.20430 of 2020(2) dt.16-07-2020 2/2 possession of the petitioner and moreover, having more or less similar allegation, some co-accused have already been granted privilege of bail.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Patna in connection with Special Case No. 172 of 2019 arising out of Gardanibagh P.S. Case No. 619 of 2019.
