The petitioner seeks bail in Special P.S. Case No.4 of 2018 arising out of Nirmali P.S.Case No.88/18 registered for the offence under Sections 20(B), 21(C) and 22(C) of the N.D.P.S.Act.

Accusation is that on receipt of secret information that two persons on motor cycle were coming having sack containing ganja the informant being Officer-in-Charge of Nirmali Police Station reached in the route of Kosi toll Plaza and he saw that one motor cycle was coming in fast speed and when he gave signal to stop the petitioner who happens to be pillion rider throwing sack started to flee away but he was apprehended who disclosed his name as Ramashish Yadav and the driver of the bike fled away.

Patna High Court Cr.Misc. No.62354 of 2018 (2) dt.06-10-2018 2/2 On search 6 Kgs. ganja was recovered from sack. Submission on behalf of the petitioner is that the sack containing 6 kg.ganja was not recovered from conscious possession of the petitioner rather the petitioner was apprehended by the police on suspicion. Though the petitioner is accused in some more cases but is on bail in all those cases. He is in custody since 16.08.2018.

Heard the learned A.P.P. also who opposed the prayer for bail of the petitioners.

Considering the facts and circumstances of the case, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of District Judge, Supaul, Special Case No.4 of 2018 arising out of Nirmali P.S.
