Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioner apprehends his arrest in connection with Masaurhi P.S. Case No. 578 of 2018 registered for the offences punishable under Sections 147, 148, 341, 337, 504, 506, 353, 307, 427 of the Indian Penal Code and section 30(a) of the Bihar Prohibition & Excise Amendment Act 2018.

The office has reported that P.S.Case no. given in the F.I.R differs with the P.S.Case no. given in the impugned order. However, learned counsel appearing for the petitioner submits that due to typing error, the learned court below has

Patna High Court CR. MISC. No.20175 of 2020(2) dt.18-08-2020 2/2 mentioned Masaurhi P.S.Case No. 578 of 2018 in place of Masaurhi P.S.Case No. 578 of 2019 in the impugned order. In view of the aforesaid submission, the defects as pointed out by the office be ignored.

So far as allegation against the petitioner is concerned, it is said that he along with several other persons obstructed the police party from discharging their official duty. Petitioner does not have any criminal antecedent. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Patna in Masaurhi P.S.Case No. 578 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
