The petitioner apprehends his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

Learned Senior counsel for the petitioner submits that the petitioner is a young boy of 23 years age having clean antecedent and the informant alleges that his mobile along with SIM was stolen from Mokama Railway Station and the same was recovered from the petitioner.

Learned Senior counsel for the petitioner submits that the petitioner has been implicated in the present case, it is next submitted that it is not in dispute that the mobile was recovered

Patna High Court CR. MISC. No.20161 of 2023(2) dt.23-06-2023 2/2 from the petitioner but then it was not the petitioner who had stolen the mobile but the petitioner committed a mistake of purchasing the mobile from his friend without knowing that the same was stolen. It is further submitted that petitioner is a young boy with clean antecedent and in the event, if he is sent to judicial custody he may come in contact with hardened criminals and his entire career will get jeopardized. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned Senior counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Rail Mokama P.S. Case No. 55 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Rishi/- U T
