Petitioner seeks bail in POCSO Reg. No.36 of 2018 arising out of Chainpur P.S. Case No.232 of 2018 instituted for the offence under Section(s) 341, 342, 354-A, 363, 504, 506/34 Indian Penal Code and Section 10 of the POCSO Act Section 37 (A) (B) of the Bihar Prohibition & Excise Act, 2016. In the written report, it is alleged that while daughter of the informant was returning home from coaching along with her friend Shweta Kumari, Nitish Kumar and Baldau Singh @ Chote took the daughter of the informant on a car on the pretext of attending birthday party. She was brought to the Chamber of this petitioner and after taking liquor they misbehaved with girl. The girl any how managed to run away.
Patna High Court Cr.Misc. No.64694 of 2018 (2) dt.26-10-2018 2/2 Statement of victim has been recorded under Section 164 Cr.P.C., which is annexed as Annexure-2 from which it appears that mere general and vague allegation has been levelled against the petitioner.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, 1stcum-Special Judge, POCSO, Kaimur at Bhabua, in connection with POCSO Reg. No.36 of 2018 arising out of Chainpur P.S. Case No.232 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) JA/- U T
