The petitioner apprehend his arrest in Mofassil (Nawada) P.S. Case No. 134 of 2016 instituted for the offence under Section (s) 420, 406, 379, 34 of the Indian Penal Code. It has been submitted that petitioner is owner of one of the pick-up-van on which the milk was alleged to be loaded from milk van tanker. The other-co-accused with similar accusation has already been granted bail vide Cr. Misc. No. 5434 of 2017 on 06.02.2017.

From the written report itself, it appears that petitioner was not present at the spot. It is alleged that milk was unloaded from milk van tanker on three pick-up-vans and

In the facts and circumstances of the case, the prayer of the petitioner for anticipatory bail is allowed. In the event of surrender/arrest of the petitioner, above named, within six weeks from today in connection with Mofassil (Nawada) P.S. Case No. 134 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, subject to the conditions as laid down under Section 438(2) of Cr.P.C.
