JUSTICE BIRENDRA KUMAR ORAL ORDER 01-10-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147,148,149,307,452,427,436 & 380 of the Indian Penal Code, Section 3/4/5 of Explosive Substance Act and Section 17 of C.L.A. Act Unlawful Activities (P) Act, 1967. Allegation is that 21 FIR named accused persons including the petitioner committed robbery in the house of the informant.

I do not find any merit in the submission of learned counsel for the petitioner that allegation is not specific against the petitioner for consideration of prayer for anticipatory bail.

Patna High Court Cr.Misc. No.60808 of 2018 (2) dt.01-10-2018 2/2 Considering the nature of allegation, I am not inclined to enlarge the petitioner on anticipatory bail in connection with Barachatti P.S.Case No.102 of 2010 pending in the court of learned Sub Divisional Judicial Magistrate, Sherghati at Gaya.

Hence, prayer is refused.

Petitioner is directed to surrender within three weeks.
