ANJANA MISHRA ORAL ORDER 20-03-2015 Heard learned counsel for the petitioners and the learned counsel for the State.
The petitioners are apprehending their arrest in connection with Sahiyara P.S. Case No.98 of 2014 for allegedly having committed the offences under Sections 341, 323, 447, 307, 354 and 379/34 of the Indian Penal Code. The allegation against these petitioners is that they had assaulted the informant and caused injury above her nose and further when the daughter of the informant came to her rescue, the petitioner also misbehaved with her and snatched her silver chain.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.43496 of 2014 (2) dt.20-03-2015 2/2 injuries in question were not such as to cause danger to life and since there is no repetition of blows, the provision of Section 307 I.P.C. would not be attracted.
Considering the aforementioned submissions and the nature of allegation, let both the above named petitioners, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi, in connection with Sahiyara P.S. Case No.98 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
