JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 10-07-2020 Heard learned counsel for the petitioner, learned Additional Public Prosecutor appearing on behalf of the State as well as learned counsel appearing on behalf of the informant. The petitioner is apprehending arrest in connection with Manihari P.S. Case No. 471 of 2019 for offences under Sections 341, 323, 324 and 307/34 of the Indian Penal Code. Having regard to the specific allegation of assault against the petitioner, the Court is not inclined to grant the privilege of anticipatory bail to the petitioner. The application is rejected. However, in the event the petitioner surrenders before the court below and seeks regular bail, the court below shall consider and dispose of the same on its own merits on the same day without being prejudiced by the order of rejection of this application.
