The petitioner has preferred this application for grant of regular bail in a case registered under sections 302, 201 and 34 of the Indian Penal Code.

As per the prosecution case, on the husband of the informant not returning home, it is stated that she received information about the petitioner having taken a 'nilgai' on his trailer after covering the same with leaves. On following him, it is stated that the dead body of her husband was found. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The death was accidental as a result of electrocution from the fence which had been placed to protect the crops from animals. As

Patna High Court CR. MISC. No.30629 of 2021(3) dt.03-01-2022 2/2 such, chargesheet has been submitted under section 304 of the Indian Penal Code. The petitioner is in custody since 29.1.2021 and has no criminal antecedent.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner, the material that has transpired in course of investigation and the petitioner having remained in custody for over 11 months, the Court directs the petitioner to be enlarged on bail in connection with Bagaha P.S. Case no.250 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Bagha, West Champaran.
