Petitioner is languishing in custody since 04.05.2016 in connection with Patori P.S. Case No. 102 of 2016 for the offences punishable under Sections 341/323/302/34 of the Indian Penal Code.
The informant is eyewitness of the occurrence. According to the F.I.R. three named persons Harishchandra Singh, Balindra Singh and Lakhindra Kumar assaulted with lathi, rod etc. at the house of the informant as a result whereof he died. In the subsequent paragraph she has claimed that this petitioner, who is elder brother of the husband and others allegedly committed the murder.
Submission of the petitioner is that due to family
Patna High Court Cr.Misc. No.52478 of 2016 (2) dt.07-12-2016 2/2 dispute the petitioner has falsely been implicated in this case. Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur/Successor Court, in connection with Patori P.S. Case No.102 of 2016.
