JUSTICE SANDEEP KUMAR ORAL ORDER 15-05-2023 Heard learned counsel for the petitioners and learned Additional Public Prosecutor appearing on behalf of the State. The petitioners seek regular bail in connection with Phulwaria P.S. Case No. 55 of 2023, registered for the offence punishable under Sections 30(a), 41(i) of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioners submits that the petitioners are innocent and they have falsely been implicated in this case. Petitioners have no criminal antecedent. No incriminating material has been recovered from the conscious possession of the petitioners. Petitioners are not the owner of the said vehicle. Petitioners are in custody since 13.02.2023.

Patna High Court CR. MISC. No.23684 of 2023(2) dt.15-05-2023 2/2 Learned APP has vehemently opposed the prayer for bail.

Considering the nature of allegation levelled against the petitioners, their period of custody, this application is allowed.

Let the petitioners, above named, be released on bail, on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.D.J.-II-cum-Special Judge Excise-1, Gopalganj in connection with Phulwaria P.S.
