Petitioner seeks regular bail in connection with G.O. Case No. 97/2021 registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act. As per prosecution case, the Excise Officials intercepted the car which was being driven by the petitioner and recovered total quantity of 162 litres of illicit liquors. Learned counsel for the petitioner submits that the petitioner has not committed any offence in the manner alleged and he has falsely been implicated in this case with oblique motive. Learned counsel further submits that petitioner is in custody since 06.03.2021 having no criminal antecedents and there is no likelihood that petitioner will abscond or tamper with the evidences, if he is released on bail. Regard being had to the submissions made by the parties and taking into consideration the material on record and the fact that petitioner is in custody since 06.03.2021 having no criminal antecedents and there is no likelihood that petitioner will abscond or tamper with the evidences, if he is released on bail, I am inclined to grant regular bail to the petitioner. Accordingly, let the petitioner, ARJUN KUMAR KAMAT be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty-five Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Madhubani in connection with G.O. Case No. 97/2021.
