The petitioner is accused in connection with Harnaut P.S. Case No. 102 of 2018 registered under Sections 356, 379, 392 and 411 of the Indian Penal Code. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. rather in course of investigation, petitioner was apprehended by the police, who got recorded his confessional statement except that nothing has been collected by the Investigating Officer against the petitioner. It is further submitted that while it is detailed in the impugned order at the time of refusing the bail prayer of the petitioner that the used motorcycle in committing loot was recovered from
Patna High Court Cr.Misc. No.62635 of 2018(2) dt.08-10-2018 2/2 possession of the petitioner but it is an error of record. It is further submitted that petitioner has no criminal antecedent and is in custody since 18.04.2018.
Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharshairf, in connection with Harnaut P.S. Case No. 102 of 2018. Out of two sureties, one surety must be the close relative of the petitioner.
