Heard learned counsel for the petitioner and learned APP for the State.

The petitioner has preferred this application for grant of regular bail in a case registered under section 21(b) of the N.D.P.S. Act.

As per prosecution case, 8 puriya of smack weighing 9.6 grams including the said puriya was recovered from the possession of the petitioner.

Learned counsel for the petitioner has submitted that the petitioner is innocent and he has falsely been implicated in

Patna High Court CR. MISC. No.20953 of 2022(2) dt.03-08-2022 2/2 this case. Learned counsel for the petitioner has further submitted that the seized contraband is less than commercial quantity. The petitioner is also accused in one case as stated at para 3 of the bail petition which is related to excise case. The petitioner is in custody since 08.12.2021.

Learned A.P.P. for the State has opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances, the petitioner above-named, is directed to be enlarged on bail after framing of charge on his furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-I, Muzaffarpur, in connection with Sadar P.S. Case No. 819 of 2021 (NDPS Case No.14 of 2022). The application stands allowed.
