2. The petitioner apprehends his arrest in connection with Halsi P.S. Case No. 88 of 2023 registered under Sections 354(A), 354(D), 466, 468, 469 and 506 of the Indian Penal Code.

3. Petitioner is alleged to have tried to molest the wife of informant and also threatened her to rape.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to ulterior motive. Further submission is that petitioner is a Government servant and posted as a Foreman (Constable) in Police Department. As a matter of fact, the sister of petitioner is married in the village of informant

Patna High Court CR. MISC. No.24888 of 2024(3) dt.30-04-2024 2/2 and due to that both parties came in relation as brother-in-law and sister-in-law and used to make joke between them. It is next submitted that the FIR has been lodged after a delay of 8 months of the alleged occurrence without any explanation. The petitioner has got no criminal antecedent.

5. Learned counsel for the State as well as for the Informant oppose the prayer for bail.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of six weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate-I, Lakhisarai in connection with Halsi P.S. Case No. 88 of 2023, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
