Most. Dharama Devi v. The Bihar State Sugar Coporation Limited And ORS.
IN THE HIGH COURT OF JUDICATURE AT PATNA
Miscellaneous Jurisdiction Case No.4703 of 2014 In Civil Writ Jurisdiction Case No. 18160 of 2013 ====================================================== Most. Dharama Devi .... .... Petitioner/s
Versus
The Bihar State Sugar Coporation Limited & Ors. .... .... Respondent/s ====================================================== Appearance :
For the Petitioner/s : Mr. Ratanakar Jha For the Respondent/s : Mr.
====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 11-01-2017 Heard.
Learned counsel appearing for the Bihar State Sugar Corporation Ltd. Patna submits that the dues of the petitioner has already been sanctioned, which is evident from perusal of Annexure-A to the show cause filed on behalf of opposite party no. 3 and the same has already been sent to District Magistrate, who is responsible for making payment to the petitioner. Learned counsel appearing for the petitioner submits that the dues of the petitioner's husband has been calculated by the corporation treating him as seasonal worker whereas petitioner's husband was regular employee and he was entitled to get his dues as regular employee grades but the same has not been done by the corporation.
In my view, if the petitioner is aggrieved by the
Patna High Court MJC No.4703 of 2014 (5) dt.11-01-2017 2/2 calculation of the corporation, she may approach the appropriate forum for redressing her grievance as the same cannot be looked into this contempt matter.
Accordingly, this contempt petition stands disposed of with liberty to the petitioner to raise her grievance before the appropriate forum in respect of Annexure-C to the show cause filed on behalf of the opposite party no. 3.
