The petitioner apprehends his arrest in connection with Basantpur P.S. Case No.1/16 registered under Sections 413 and 414 of the Indian Penal Code.

The accusation is that on receiving secret information about concealing of theft truck by Brajesh Singh, the police apprehended Brajesh Singh who disclosed about keeping of theft thruck in a garage of one Basant Prasad. Thereafter Basant Prasad was apprehended who disclosed that Jai Prakash and his brother Guddu Singh (petitioner) and Brajesh Singh had brought the truck for changing its colour.

Learned counsel for the petitioner submits that, in fact,

Patna High Court Cr.Misc. No.12816 of 2017 (2) dt.11-04-2017 the petitioner is not named in the F.I.R. but his name has surfaced on the basis of confessional statement of co-accused . Considering the facts and circumstances of the case and nature of offence, I am not inclined to grant anticipatory bail to the petitioner. The prayer for anticipatory bail of the petitioner is rejected.
