Petitioners seek bail in Barun P.S. Case No.206 of 2016 instituted for the offence under Section(s) 394 Indian Penal Code.

Counsel for the petitioners submits that petitioners are not named in the First Information Report. There is no recovery of incriminating article from their possession. No Test Identification Parade has been held. Their names have come in the confessional statement of Babani Mandal. They are in custody since 20.07.2018 having clean antecedents. It has further been submitted that co-accused,

Patna High Court Cr.Misc. No.62094 of 2018 (2) dt.09-10-2018 2/2 Babuni Mandal, has been granted bail by co-ordinate Bench of this Court by order dated 13.03.2018 passed in Cr. Misc. No.14193 of 2018.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad, in connection with Barun P.S. Case No.206 of 2016, subject to the condition that both the bailors shall be close relative of the petitioners.
