JUSTICE SATYAVRAT VERMA ORAL ORDER 06-01-2023 Heard learned counsel for the petitioner and learned A.P.P. for the State through the virtual Court proceedings. The petitioner seeks bail in a case registered for the offences punishable under Section 366(A) of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is in custody since 26.12.2021 and is a person with clean antecedent and the informant alleges that his minor daughter aged about 17 years was enticed by the petitioner for the purpose of marriage.
Learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case, it is next submitted that petitioner and the victim were in love and the victim had reached the age of discretion though she is a
Patna High Court CR. MISC. No.20650 of 2022(4) dt.06-01-2023 2/2 major but the same is not being disputed for the present, it is also submitted that the victim came back and her statement was recorded under Section 164 Cr.P.C. wherein she has not supported the case of the prosecution.
Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the submission made by the learned counsel for the petitioner, the petitioner above named be released on bail on furnishing bail bond of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of the learned trial court where the case is pending/successor court in connection with Begusarai P.S. Case No. 778 of 2021.
