JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 15-02-2017 The petitioner is admittedly grand-daughter of opposite party No. 2. In such circumstance, dismissal of her application filed under Section 125 of the Code of Criminal Procedure, she being a major, by the impugned order dated 14.08.2014 passed by learned Principal Judge, Family Court, Madhepura cannot be said to be illegal. This revision application preferred against the said order dated 14.08.2014 has no merit. Learned counsel for the petitioner has, however, submitted that the opposite party No. 2 himself deposed before the court below that he was holding one and half bigha of land and that he was ready to give the share, which the petitioner is entitled to.
Patna High Court CR. REV. No.894 of 2014 (3) dt.15-02-2017 2/2 In view of the stand taken by opposite party No. 2 before the court below, no order need be passed in the present proceeding, preferred against the order dated 14.08.2014. This application stands disposed of.
