The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 379, 427 of the Indian Penal Code and 3(1) (x) of the S.C./S.T.(Prevention of Atrocities) Act. Prosecution case is that petitioner and four unknown persons committed theft in the house of the informant and abused him by calling caste name. Coaccused Rahul Mandal snatched Rs.3300/- and mobile from Angad Das. Accused Bugo Mandal assaulted Diwarkar Das with lathi and snatched silver chain. It is submitted by the learned counsel for the petitioner that neither specific accusation of committing theft nor
Patna High Court Cr.Misc. No.36566 of 2015 (2) dt.10-09-2015 abusing the informant has been levelled against the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Md. Salim, Judicial Magistrate, Ist Class, Bhagalpur in connection with Sabour (Goradih) P.S. Case No. 247 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
