The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 307, 504 and 34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent, petitioner no.2 is a women and the informant alleges that petitioner no.1 came and demanded to return Rs. 100 on which he said that presently he does not have money on which petitioner no.1 abused and assaulted him, further when informant's daughter and son came to save him, they were also assaulted by petitioner no.1 causing
Patna High Court CR. MISC. No.20924 of 2022(2) dt.01-11-2022 2/3 injury on head of his daughter and on intervention of villagers, the matter was pacified, it is further alleged that thereafter petitioner no.2 along with Pawan came and abused and threatened the informant.
Learned counsel for the petitioners submits that petitioners have been falsely implicated in the present case, it is next submitted that the injury suffered is simple in nature as the impugned order does not record that the injuries are grievous, it is also submitted that in the nature of allegation also it appears that on a trivial issue, the occurrence took place and the petitioners are not criminals.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.
Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Bounsi P.S. Case No. 04 of 2020 subject to the conditions as laid down
