JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Danapur P.S. Case No. 431 of 2016 registered for the offences punishable under Sections 406, 420 and 120B of the Indian Penal Code.

As per complaint petition, on the basis of which FIR has been registered, the petitioner has persuaded the informant to pay Rs.2 lac with respect to provide job to his son and he handed over the money to one Harendra Kumar Singh in presence of petitioner. Complaint petition further disclosed that they have returned Rs.45,000/- to the complainant/informant and for remaining amount Harendra Kumar Singh issued a cheque, which bounced.

Submission of learned counsel for the petitioner is that as per direction of this Court by order dated 3.1.2018

Patna High Court CR. MISC. No.32263 of 2019(4) dt.24-09-2019 2/2 passed in Cr.Misc.No. 60980 of 2017 the said Harendra Kumar Singh has deposited Rs.1.55 lac, which will appear from Annexure-6 (counterfoil of the receipt granted by Cashier) and on such deposit he has been released on bail, which will appear from Annexure-7, the order dated 16.2.2018 passed in Danapur P.S. Case No. 431 of 2016, as such total amount has now been returned.

In view of above facts and circumstances, this application is disposed of with direction to the petitioner to surrender in the court below and learned court below shall verify the above submission and if it is found true, the petitioner shall be released on bail by the court below itself to its own satisfaction.
