2. The petitioner seeks regular bail in connection with NDPS Case No. 54 of 2021 / CIS No. 54 of 2021 arising out of Raxaul P.S. Cae No. 224 of 2021 registered for the offence under Sections 20 (b), (ii), (c), 23(c) of the NDPS Act.

3. As per the prosecution case, there is recovery of 10 kg of Charas.

4. It has been submitted by the learned counsel for the petitioner, on instruction, that only two witnesses have been examined in the trial.

5. The petitioner is in custody since 21.06.2021.

6. In view of the quantum of recovery, this Court is not inclined to grant bail to the petitioner.

7. Accordingly, this application is dismissed.

8. The Superintendent of Police, East Champaran is directed to ensure the attendance of the witnesses on the dates fixed in the trial and if the trial of the petitioner is delayed due to the fault of the prosecution side then the petitioner may renew his prayer for bail.

9. Let a copy of this order be communicated to the Superintendent of Police, East Champaran through FAX for its compliance.
