JUSTICE SANJAY PRIYA ORAL ORDER 07-03-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Barauni (Chakia) P.S. Case No. 344 of 2016 instituted for the offence under sections 379 and 427 of the Indian Penal Code. It is alleged in the written report that informant who is posted as Zonal Coordinator in NCR Corporation of India, Pvt. Company received a message from call center, Bombay that the A.T.M. machine installed at old B.T.P.S., Main Gate has broken down. The informant went to the site and saw out of two machines, one ATM machine has been damaged and theft has been committed in another after uprooting the same During investigation, the name of this petitioner has come in paras 15, 23 an 29 of the case diary, about his

The petitioner is having criminal antecedent and five cases are pending against him.

Under such circumstances, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner is rejected. However, the petitioner is directed to surrender before the court below and seek regular bail which shall be considered and disposed off on its own merit without being prejudiced by this order.
