====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 02-04-2019 Heard learned counsel for the petitioners and the State.
The petitioners seek bail in Hulasganj P.S. Case No. 149 of 2018, instituted for the offence under Section(s) 147, 148, 149, 307 of Indian Penal Code and Section 27 of the Arms Act.
Counsel for the petitioners submits that there is no injury from other side. The name of petitioners have come in the First Information Report merely on suspicion. It is alleged in the written report that informant got information that firing has taken place between two groups on
Patna High Court CR. MISC. No.20188 of 2019(2) dt.02-04-2019 2/2 account of land dispute. The informant reached the village and heard sound of firing. It is further alleged that on arrival of Police, the miscreants managed to run away. The informant learnt from the villagers that one side was headed by co-accused Kopendra Sharma and his supporters and other side was headed by Manjeet Sharma (petitioner No. 1) and his supporters. Petitioners are in custody since 21.01.2019.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Jehanabad, in connection with Hulasganj P.S. Case No. 149 of 2018, subject to the condition that both the bailors will be close relatives of the petitioners.
