17-10-2016 Heard Sri Manoj Kumar Singh, learned counsel for the petitioner and Sri Lakshmi Kant Sharma, learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 11-01-2016, has prayed for grant of bail in Mahila P.S. Case No. 53 of 2015 registered for offence under Section 354 'A' of the Indian Penal Code and Sections 7 & 8 of the Protection of Children from Sexual Offences Act, 2012 (POCSO Act) Case No. 64 of 2015.
Learned counsel for the petitioner submits that petitioner is having clean antecedent and due to dispute in respect of passage, the petitioner has falsely been implicated and he is languishing in jail since long.
Patna High Court Cr.Misc. No.40966 of 2016 (3) dt.17-10-2016 2/2 Learned Addl. Public Prosecutor has opposed the prayer for grant of bail.
However, considering the nature of accusation, period of custody as well as clean antecedent of the petitioner, as stated in paragraph - 3 of the petition, let the petitioner namely Nurullah @ Md. Nurullah be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge-cumSpecial Judge, Begusarai in connection with Mahila P.S. Case No. 53 of 2015.
