JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-05-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 302, 201 and 34 of the Indian Penal Code.
Petitioner is not named in the F.I.R. During investigation his name has transpired.
Heard learned counsel for the petitioner.
It has been submitted on behalf of the petitioner that only on suspicion petitioner has been made accused in this case. There is land dispute between the parties from before. Heard learned A.P.P. also. He has opposed the prayer for anticipatory bail stating that petitioner along with other coaccused persons has assaulted the deceased which is also mentioned in the order impugned.
Patna High Court Cr.Misc. No.19265 of 2017 (2) dt.09-05-2017 2/2 Having heard both sides and in view of the submission made above, I am not inclined to grant anticipatory bail to the petitioner.
However, petitioner is directed to surrender in the court below, i.e., learned Judicial Magistrate, Ist Class, Udakishunganj, Madhepura, and make prayer for regular bail which will be considered on the basis of materials available on record and pass appropriate order in accordance with law without being prejudiced by the order of this Court.
