Petitioner seeks bail in connection with Khagaria (Mufassil) P.S. Case No. 254 of 2018 registered for the offence punishable under section 307 and other allied sections of the Indian Penal Code.
Learned counsel appearing for the petitioner submits that petitioner has been falsely implicated in this case at the instances of his enemies. Nothing specific has been alleged against this petitioner. As a matter of fact, the informant fell down from his house and sustained fracture injury on his hand. The present first information report has been lodged after delay of about five days without any explanation. Petitioner is in custody since 10.05.2018.
Patna High Court Cr.Misc. No.61233 of 2018(2) dt.06-10-2018 2/2 Learned Addl. P.P. appearing for the State opposes the prayer for bail and submits that there is specific allegation of assault against this petitioner. During investigation witnesses have supported the prosecution case. Moreover, petitioner has a very long criminal history.
Considering the nature of allegations levelled, the materials available on record and the submissions advanced on behalf of the parties, this Court does not find it to be a fit case for grant of bail to the petitioner. The same is, therefore, rejected.
