The petitioner is apprehending his arrest in connection with Marhaura (Gaura O.P.) P.S.Case no.308 of 2018 registered for offences punishable under Sections 328, 302, 34 of the Indian Penal Code.

Petitioner happens to be husband and there is allegation against him and other accused persons that they administered poison causing of death of his wife.

Submission of the learned counsel for the petitioner is that the allegation is false and concocted and he has been falsely implicated in this case.

Heard learned A.P.P. and perused the report submitted by the F.S.L. that clearly disclose that aluminium phosphide was

Patna High Court CR. MISC. No.21048 of 2019(4) dt.02-08-2019 2/2 detected during the examination of the viscera and as per the learned A.P.P. witnesses have also supported the prosecution case.

In such view of the matter, I am not inclined to grant privilege of anticipatory bail to the petitioner, hence this application is dismissed and the office is directed to send the F.S.L. report to the Director of the Forensic Science Laboratory at once so that it may be submitted before the court concerned. With the aforesaid direction, this application is dismissed.
