2. The petitioner seeks regular bail in connection with Saharsa Sadar P.S. Case No. 1083 of 2018 registered for the offence under Sections 353, 307, 333, 334, 337, 34 of the Indian Penal Code and Sections 25(1-B)a, 26, 27 & 35 of the Arms Act.

3. As per the prosecution case, the police team conducted a raid and after seeing the police party, the petitioner opened fire on the raiding team.

4. Learned counsel for the petitioner submits that petitioner is innocent and has not committed any offence. Petitioner is in custody since 06.10.2018 and the trial is still pending.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the period of custody and the delay in trial, this application for regular bail is allowed.

7. Accordingly, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand)with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-IV, Saharsa/concerned Court below in connection with Saharsa Sadar P.S. Case No. 1083 of 2018 subject to condition that:- (i). The petitioner will mark his attendance at the Bithan Police Station, Samastipur on the first & third Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

(ii) The petitioner shall appear in the trial regularly either personally or through his lawyer and shall cooperate in the trial and noncooperation in the trial shall result in cancellation of the bail bond of the petitioner.

8. The application for bail stands allowed.
