JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-10-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 11.9.2017 passed in Cr.Misc.No. 41858 of 2017 and allegation against him is of attempting to commit rape upon minor grand daughter of the informant. Submission of learned counsel for the petitioner is that petitioner is in custody for more than 15 months and there is no substantive progress in trial although there was direction of this Court to conclude the trial within a period of seven months and petitioner was given liberty to renew his prayer for bail. Heard learned APP also.

Having heard both sides and in the facts and circumstances and also considering the period of custody, let the petitioner, named above, be released on bail on furnishing bail

Patna High Court Cr.Misc. No.62536 of 2018 (2) dt.10-10-2018 2/2 bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge-I, Saran, in connection with Sessions Trial No. 22 of 2017, arising out of Manjhi P.S.Case No. 118 of 2017, subject to the condition that one of the bailors shall be a family member of the petitioner having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that petitioner has to co-operate in disposal of trial and appear in court as and when required, otherwise his bail bond shall be cancelled.
