No. 20965 of 2015 to the extent that the petitioners withdrew the application with regard to petitioner nos. 2 and 3, namely, Jai Mangal Mahto and Binay Mahto @ Binay Singh, but inadvertently it was wrongly submitted for withdrawal of the application on behalf of petitioner nos. 2 and 4, namely, Jai Mangal Mahto and Dinesh Singh @ Dinesh Mahto whereas the application with regard to petitioner nos. 1, 3 and 5, namely, Suresh Mahto, Binay Mahto @ Binay Singh and Chalitar Mahto were disposed of. On the grounds mentioned in the modification application, the order dated 23.06.2015 passed in Cr. Misc. No.

Patna High Court Cr.Misc. No.37311 of 2015 (02) dt.19-08-2015 2/2 20965 of 2015 is modified to the extent that anticipatory bail application with regard to petitioner nos. 2 and 3, namely, Jai Mangal Mahto and Binay Mahto @ Binay Singh were directed to be withdrawn since they were arrested whereas with regard to petitioner nos. 1, 4 and 5, namely, Suresh Mahto, Dinesh Singh @ Dinesh Mahto and Chalitar Mahto the application was directed to be disposed of. The period of surrender is further extended for three weeks from the date of receipt/production of a copy of this order in connection with Sitamarhi P.S. Case No. 206 of 2015 pending in the court of learned Chief Judicial Magistrate, Sitamarhi.

Accordingly, this modification application is disposed of.
