JUSTICE RAKESH KUMAR ORAL ORDER 30-11-2016 Heard Sri Ajay Kumar Sinha , learned counsel who was assisted by Sri Sudhir Kumar Sinha, learned counsel for the petitioner and Sri Madan Kumar , learned Additional Public Prosecutor This is second attempt for grant of bail. Earlier on 19.1.2016 vide Cr. Misc. No. 57425 of 2015 the prayer for bail of the petitioner was rejected mainly on the ground that there was accusation that petitioner was the main assailant as well as the fact that petitioner was having criminal antecedent. Learned counsel for the petitioner submits that during the trial out of ten witnesses six witnesses have already been examined including the informant however they have not supported the prosecution case.

Patna High Court Cr.Misc. No.50901 of 2016 (2) dt.30-11-2016 2/2 Be that as it may appraisal of evidence can be done by the trial court not by this court that too while hearing bail petition. The petition again stands dismissed.
