The petitioners apprehend their arrest in connection with Jehanabad P.S. Case No. 02 of 2016 registered for the offences under Sections 420, 431, 379 and 411/34 of the Indian Penal Code and Rules 4(1) and 33 of the Bihar Miner & Minerals Concession Rule, 1972.

In view of the fact that the petitioners are involved in illegal mining of sand and carrying the sand loaded on the seized truck of petitioner no.1, this is not a fit case for grant of

Patna High Court CR. MISC. No.30059 of 2021(2) dt.04-03-2022 2/2 anticipatory bail to them. This application for anticipatory bail is dismissed.

In case the petitioners surrender and pray for regular bail before the court below within a period of four weeks from today, the court below will consider the petition for regular bail of the petitioners without being prejudiced by the fact that anticipatory bail petition has been rejected by this Court.
