JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-01-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 414 of the Indian Penal Code. Petitioner is in jail custody since 19.08.2016 on the accusation that he and one Gopal Kumar Singh were caught with stolen motorcycle.

Submission on behalf of the petitioner is that coaccused, Gopal Kumar Singh has already been granted privilege of bail by the learned trial court itself and so far as petitioner is concerned, he happens to be bona fide purchaser of aforesaid seized motorcycle. Moreover, petitioner does not have any

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in connection with Sadar P.S. Case No. 315 of 2016.
