JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-04-2019 Earlier prayer for bail of the petitioner was dismissed vide order dated 17.09.2018 passed in Cr. Misc. No. 46555 of 2018 and allegation against the petitioner is of committing unnatural offence.
Submission of learned counsel for the petitioner is that the co-accused having similar allegation has already been enlarged on bail by a coordinate Bench of this Court vide order dated 13.02.2019 passed in Cr. Misc. No. 69084 of 2018 and petitioner has been in custody since 15.05.2018. Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on
Patna High Court CR. MISC. No.22530 of 2019(2) dt.11-04-2019 2/2 furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate - IX, Bhojpur at Arrah, in connection with Trial No. 2302 of 2017 arising out of Complaint Case No. 947-C of 2017, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
