The petitioner has preferred this application for grant of regular bail in a case registered under section 302 and other sections of the Indian Penal Code.

As per the prosecution case, the fourteen named accused persons including the petitioner herein are stated to have come variously armed and assaulted the informant and others leading to death of one Awadh Prasad.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. So far as the allegation of assault on the deceased Awadh Prasad is concerned, the same is on coaccused Birendra Kumar and not

Patna High Court CR. MISC. No.34396 of 2021(3) dt.20-01-2022 2/2 the petitioner herein. The petitioner is alleged to have assaulted one Prahlad Kumar whose injuries have been found to be simple in nature. The petitioner is in custody since 2.2.2021 and has no criminal antecedent.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the material that has transpired in course of investigation and the petitioner having remained in custody for over 11 months, the Court directs the petitioner to be enlarged on bail in connection with Sirdala P.S. Case no. 293 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Nawada.
