The present application has been filed for modification of the order dated 07.03.2014 passed in Criminal Miscellaneous No.52058 of 2013 for rescinding the condition of depositing the due amount of the paddy supplied by Bihar State Food and Civil Supplies Corporation Ltd. in connection with Madhepura P.S. Case No.105 of 2013, pending before the learned CJM, Madhepura.

The earlier order reflects that on submission on behalf of the petitioner that he is ready to deposit the cost whatever has accrued, the petitioner was granted anticipatory bail, subject to filing of duly verified application supported with personal affidavit depositing the amount within eight weeks. Now, through this modification application, learned counsel for the petitioner submits that the accusation is regarding non-supply of CMR to the Food Corporation of India and thereby

Patna High Court Cr.Misc. No.37558 of 2015 (4) dt.30-09-2015 2/2 misappropriation of Rs.1,28,30,921/- but the petitioner was not a party to the agreement.

Considering the fact that earlier order was passed on the undertaking of the petitioner, this Court is not inclined to interfere into the matter.

Accordingly, the modification application is disposed of.
