2. The petitioners apprehend their arrest in connection with Sakra P.S. Case No. 489 of 2025, instituted for the offences punishable under Sections 126(2), 115(2), 117, 118, 109, 352, 351(2), 351(3), 303(2), 76, 3(5) of the B.N.S.
3. As per the prosecution case, on the date of occurrence, when the son and nephew of the informant returning from market and when they were about 200 meters away from their home, his neighbours, 10 in number, including petitioners
Patna High Court CR. MISC. No.20856 of 2026(3) dt.01-07-2026 2/3 having armed with various weapons came there and started abusing and assaulted causing injuries to them. The informant, his wife and another nephew were also assaulted by the accused persons when they came to save them. On protest, Petitioner No. 2 assaulted the son of informant with iron rod causing injury on his head. The accused persons also assaulted the nephew of informant. When the informant came to save them, he was also assaulted on his head by Petitioner No. 1.
4. Learned counsel for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. Petitioners and informant are agnates. Due to land dispute, some altercation took place between the parties. Earlier, a case was lodged by the petitioner's side and to save the skin from the said case, the present case is lodged by the informant. Petitioners' side also got injured. Petitioners have one criminal antecedent which was earlier lodged by the informant's side in which they are on bail. Injuries to the injured are simple in nature. Petitioners undertake to co-operate in the investigation and trial.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.
6. Considering the facts and circumstances of the
Patna High Court CR. MISC. No.20856 of 2026(3) dt.01-07-2026 3/3 case, submission of learned counsel for the parties and there is case and counter case between the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioners, above-named, be released on bail upon furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., East Muzaffarpur in connection with Sakra P.S. Case No. 489 of 2025, subject to the conditions laid down in Section 482 (2) of the Bharatiya Nagrik Suraksha Sanhita (B.N.S.S.), 2023.
