The petitioner seeks regular bail in connection with Sessions Trial No.780 of 2018 arising out of Khajekalan P.S.Case No.275 of 2018 registered for offences punishable under 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the FIR, the prosecution story is that 11 accused persons including the petitioner fired indiscriminately on the deceased causing his death.

Submission of the learned counsel for the petitioner is that there is general and omnibus allegation against the petitioner and he is in custody since 12.9.2018. and one coaccused having similar allegation has been granted bail by a

Patna High Court CR. MISC. No.18155 of 2019(3) dt.21-05-2019 2/2 Co-ordinate Bench of this Court vide order dated 16.1.2019 passed in Cr. Misc. No.78712 of 2018 and another accused person has been granted bail, vide order dated 13.3.2019 passed in Cr. Misc. No.15379 of 2019.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 7th Addl. Sessions Judge, Patna City, Patna in connection with Sessions Trial No.780 of 2018 arising out of Khajekalan P.S.Case No.275 of 2018 with condition to co-operate in the trial and shall appear before the learned court below as and when required otherwise his bail bond shall be cancelled..

With the above direction, this application is allowed.
