Heard learned counsel for the petitioner and learned APP for the State.

Since the physical court proceeding is non-functional, due to present pandemic, COVID-19, the matter is listed with defects.

Learned counsel for the petitioner undertakes to remove the defects within three weeks of resumption of physical court proceeding. In the eventuality of non-removal of defects within undertaken period, the office will place the matter before the bench.

Patna High Court CR. MISC. No.19419 of 2020(2) dt.13-08-2020 2/3 The present application has been filed for modification of order dated 24.02.2020 passed in Cr. Misc. No. 86823 of 2019 to the extent of impleading the alias name of the father of the petitioner and making correction in the affidavit portion as the father has been described as the uncle of the petitioner.

It appears that the petitioner was granted anticipatory bail vide order dated 24.02.2020 passed in Cr. Misc. No. 86823 of 2019 in connection with Dawath P.S. Case No. 144 of 2019 registered for the offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016, as amended by Act 8 of 2018, pending in the Court of learned Special Judge, Excise Act, Rohtas at Sasaram.

It is submitted by learned counsel for the petitioner that the petitioner's father name is Manoj Kumar Singh @ Manoj Kumar Yadav, though, the actual name is Dashrath Singh. The affidavit of the petitioner was sworn by father but it was written as Dashrath Singh but he has been described as uncle of the petitioner.

In the circumstances, the order dated 24.02.2020 passed in Cr. Misc. No. 86823 of 2019 is modified to the extent that the name of the father of the petitioner be read as Manoj

No.19419 of 2020(2) dt.13-08-2020 3/3 Kumar Singh @ Manoj Kumar Yadav @ Dashrath Singh and in the affidavit portion the learned counsel for the petitioner is permitted to make correction to the extent that the deponent is the father of the petitioner. The period of surrender is further extended by three weeks from the date of receipt/production of a copy of this order.

Accordingly, the modification application stands disposed of.
