JUSTICE JYOTI SARAN ORAL ORDER 13-08-2015 Heard Mr. Ishwari Singh, learned counsel for the petitioner and learned counsel for the State. The petitioner has questioned the order dated 03.08.2014 / 21.10.2014 passed by the Additional Registrar, Co-operative Societies, Bihar, Patna in Election Dispute Case No. 62 of 2012 circulated vide Memo No. 6096 dated 24.10.2014 whereby the election to the managing committee of Chehrakala Prakhand Matasyajivi Sahyog Samiti Limited, Chehrakala, District-Vaishali has been upheld and the election petition has been dismissed. The election has been questioned by the petitioner on grounds of infirmities in the voter list. It is not in dispute that the petitioner has contested the election on the same voter list and having been unsuccessful now he seeks to question the same on grounds of infirmity therein. Having participated in the election, the
Patna High Court CWJC No.12379 of 2015 (2) dt.13-08-2015 petitioner cannot be permitted to question the voter list at this stage. The law on the issue stands well settled in the Bench decision of this Court reported in 2006(1) PLJR 184 and for the same reason no indulgence can be granted to the petitioner. The writ petition is dismissed.
