Heard learned counsel for the petitioner.

Petitioner prays for bail in connection with Ahiyapur P.S.Case No. 495 of 2018 registered for the offences punishable under Sections 448, 341, 323, 387 and 352/34 of the Indian Penal Code.

Allegation as per FIR is that the informant, who is owner of the house, has given the house to one Ashok Jha as caretaker and Ashok Jha has given the house on rent to the petitioner and when informant demanded rent from the petitioner he abused her and demanded Rs.3 lakhs as extortion.

Patna High Court Cr.Misc. No.60762 of 2018 (2) dt.06-10-2018 2/2 Submission of learned counsel for the petitioner is that he is tenant and has already paid the rent to the informant and the allegation of demand of extortion is false and concocted and he is in custody since 17.5.2018.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-III, East Muzaffarpur, District Muzaffarpur, in connection with Ahiyapur P.S.Case No. 495 of 2018, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
