====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 25-11-2021 Heard the learned Advocate for the petitioner and the learned APP for the State.

The petitioner seeks bail in connection with Noorsarai P. S. Case No.127 of 2020, instituted for the offences under Sections 304(B)/ 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 31.01.2021 and he is a person with clean antecedent, charge-sheet has been submitted in the case. The learned counsel for the petitioner further submits that from perusal of the allegation as alleged in the F.I.R., it would manifest that the informant alleges that the deceased was killed by the family members including this petitioner for nonfulfilment of demand of dowry. No.31121 of 2021(2) dt.25-11-2021 2/2 father-in-law, against whom the allegation is similar to that of the present petitioner, has been granted anticipatory bail by order dated 08.04.2021 in Cr. Misc. No.39315 of 2020. The learned counsel for the petitioner submits that being mother-in-law, she has been falsely implicated as she along with her husband were separate in mess and property. Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 31.01.2021 and he is a person with clean antecedent, charge-sheet has been submitted in this case and similarly situated co-accused has been granted anticipatory bail, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-7, Biharsharif, Nalanda in connection with Noorsarai P. S. Case No.127 of 2020. The application stands allowed.
