====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ---------------- 01-05-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Barauni Rail P.S. Case No.102 of 2016 registered under Section 379 of the Indian Penal Code.

Learned counsel appearing on behalf of the petitioner submits that the petitioner is not named in the F.I.R. In course of investigation, it has come that SIM Nos.8804118184, 7272953614 and 9534531514 were being used in the stolen mobile. One Anil Sharma stated that he used to talk through his mobile to his brother-in-law Shrawan Kumar, who used to said SIMs, and he used to run the mobile shop. Since the petitioner is the brother of

Patna High Court Cr.Misc. No.5163 of 2017 (4) dt.01-05-2017 2/2 Shrawan Kumar, the petitioner has also been falsely implicated in this case.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Railway, Barauni (Begusarai), in connection with Barauni Rail P.S. Case No.102 of 2016, subject to the conditions laid down under Section 438(2) Cr.P.C.
